These Terms & Conditions (“Terms”) govern your access to and use of the services provided by Om’s Martial Arts & Fitness Studio (hereinafter referred to as “Om’s Academy”, “we”, “us”, or “our”), located at C6/1, Sandhya Marg, Akruti Apartments, Chitrakoot, Jaipur, Rajasthan, India.
By enrolling in any program, attending classes, using our website (omsacademy.org), or accessing our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services & Programs
Om’s Academy offers various martial arts and fitness programs including Taekwondo, Kickboxing, MMA Training, Power Yoga, Self-Defence, Weight Management, and Live Online Classes. All programs are subject to availability, schedule changes, and instructor discretion.
2. Membership & Registration
- All students must complete the registration process and provide accurate personal information.
- Membership is personal and non-transferable.
- Parents/guardians must register on behalf of minors (below 18 years).
- We reserve the right to accept or reject any application at our sole discretion.
3. Fees & Payment
- All fees are payable in advance as per the chosen program plan.
- We accept payments through online methods, UPI, bank transfer, or cash (at academy).
- Fees are non-refundable except as mentioned in the Refund Policy below.
- Late payments may attract late fees or suspension of services.
4. Refund & Cancellation Policy
- No refund will be issued after 7 days of enrollment or after attending more than 2 classes, whichever is earlier.
- Refund requests due to medical reasons (with valid doctor’s certificate) may be considered on a case-by-case basis, subject to a 10-15% processing fee.
- Online classes once started are generally non-refundable.
- We reserve the right to modify fees with prior notice.
5. Health & Medical Disclaimer
- All participants must be in good physical and mental health.
- By joining, you confirm that you have no medical condition that may be aggravated by physical activity.
- Liability Waiver: You voluntarily assume all risks of injury, illness, or damage associated with training. Om’s Academy, its owners, coaches, and staff shall not be liable for any injury, loss, or damage caused during classes, except in cases of gross negligence.
- Minors’ parents/guardians are fully responsible for their child’s health declaration.
6. Code of Conduct
Students are expected to maintain discipline, respect coaches and fellow students, and follow academy rules:
- Arrive on time and in proper uniform.
- No aggressive or disrespectful behavior.
- Maintain personal hygiene.
- Inform the coach in advance if unable to attend classes.
- Mobile phones must be on silent during class.
- Any violation may result in warning or termination of membership without refund.
7. Intellectual Property
All content on our website, training materials, videos, logos, and course content are the property of Om’s Martial Arts & Fitness Studio and protected by copyright. You may not reproduce, distribute, or use them for commercial purposes without written permission.
8. Privacy Policy
Your personal data is handled as per our Privacy Policy. By using our services, you consent to the collection and use of your information.
9. Termination
We may terminate or suspend your membership at any time for violation of these Terms, non-payment, or behavior detrimental to the academy environment. In such cases, no refund will be provided.
10. Limitation of Liability
To the fullest extent permitted by law, Om’s Academy shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes your acceptance of the updated Terms.
