Refund & Cancellation Policy

1. Introduction & Our Commitment
Om's Martial Arts & Fitness Studio ("Om's Academy," "we," "us," or "our") is committed to transparency and fairness in all financial dealings with our students and their families.
This Refund & Cancellation Policy ("Policy") explains the terms and conditions under which refunds, credits, or adjustments may be requested and processed for our programs, memberships, and services. This Policy is designed in compliance with:
- The Consumer Protection Act, 2019 (particularly Section 2(47) regarding unfair trade practices)
- The Indian Contract Act, 1872 (Sections 23 and 70)
- The Consumer Protection (E-Commerce) Rules, 2020 (Rule 5(3))
- Applicable Reserve Bank of India (RBI) guidelines on digital payment refunds
This Policy applies to all programs offered by Om's Academy, including but not limited to Taekwondo, Kickboxing, MMA Training, Power Yoga, Self-Defence Workshops, Weight Management Programs, Personal Training, and Live Online Classes — whether conducted in-person at our Jaipur academy or online.
Important: This Policy forms an integral part of our Terms & Conditions and Privacy Policy. By enrolling in any program, you acknowledge that you have read and understood this Policy.
2. Cooling-Off Period (Full Refund Window)
We provide a 7-calendar-day cooling-off period from the date of enrollment or first payment, whichever is later. During this period:
- You may request a full refund of all fees paid, provided you have attended no more than 2 classes (including trial classes).
- A non-refundable registration/admission fee (if charged separately and disclosed at the time of enrollment) of up to ₹500 may be deducted.
- The cost of any uniform, equipment, or study material already issued to you will be deducted at actual cost.
- The refund will be processed within 15 business days of receiving your written request.
How to request: Send an email to omsfitness@gmail.com with the subject line "Cooling-Off Refund Request — [Student Name]", or submit a written request at the academy front desk.
3. Refund After the Cooling-Off Period
After the 7-day cooling-off period, fees are generally non-refundable. However, in the following circumstances, a pro-rated refund may be granted:

"Unused fees" means the total fees paid minus the value of classes/sessions already attended, calculated on a pro-rata basis (Total Fees ÷ Total Scheduled Classes × Classes Attended = Amount Used).
4. Medical & Compassionate Grounds
We understand that health and personal circumstances can change unexpectedly. Refunds on medical or compassionate grounds will be considered as follows:
- Medical Grounds: If a student is unable to continue training due to a documented medical condition, injury, or illness (supported by a valid certificate from a registered medical practitioner), a pro-rated refund of unused fees will be issued after deducting a 10–15% processing fee.
- Pregnancy: Expectant mothers may either request a pro-rated refund or a membership freeze (see Section 8) for the duration of pregnancy and recovery period.
- Compassionate Grounds: In cases of bereavement of an immediate family member, serious family emergency, or other exceptional circumstances, refund requests will be reviewed on a case-by-case basis by the academy management. Supporting documentation may be requested.
- For Minors: The parent/guardian must submit the refund request along with the medical certificate and the child's enrollment details.
Medical refund requests must be submitted within 30 days of the medical event or diagnosis. Late requests may still be considered at management's discretion.
5. Service Deficiency & Academy-Caused Cancellations
In compliance with the Consumer Protection Act, 2019, you are entitled to a refund in the following situations regardless of the cooling-off period:
- Program/Batch Cancelled by Academy: If we cancel a program, batch, or course due to insufficient enrollment, operational issues, or any reason attributable to us, a full refund of all unused fees will be issued within 15 business days. No processing fee will be deducted.
- Service Deficiency: If there is a proven deficiency in our services — such as persistent unavailability of instructors, significant deviation from the advertised curriculum, failure to provide promised facilities, or repeated cancellation of scheduled classes — you are entitled to a proportionate refund of fees for the deficient period.
- Instructor Unavailability: If a specific instructor you enrolled with becomes permanently unavailable and no suitable replacement is offered or accepted, you may request a pro-rated refund.
- Relocation of Academy: If the academy relocates to a new premises that is materially inconvenient for you, you may request a full refund of unused fees.
- Force Majeure (Prolonged): If classes are suspended for more than 30 consecutive days due to government orders, natural disasters, epidemics, or other force majeure events, affected members may choose between:
- (a) A pro-rated refund of unused fees, or
- (b) A credit/extension of their membership for the equivalent period, or
- (c) Alternative online classes at no additional cost (if available)
Note: Under the Consumer Protection Act, 2019, a blanket "No Refund" policy is considered an unfair trade practice under Section 2(47). We do not enforce any such blanket restriction. If you believe our services have been deficient, you have the right to seek a refund and, if unresolved, approach the District Consumer Disputes Redressal Commission under Section 35 of the Act.
6. Online Classes & Digital Programs
- Before Commencement: If you cancel before the first live online class begins, a full refund (minus any registration fee) will be issued.
- After Commencement: Once a live online class or digital course has commenced, fees are generally non-refundable, as the seat/slot has been allocated and content delivery has begun.
- Exception — Technical Failure: If you are unable to attend online classes due to a technical failure on our end (e.g., platform outage, instructor's internet failure) for more than 3 consecutive sessions, you may request a pro-rated refund or make-up classes.
- Exception — Service Deficiency: If the online class content materially deviates from what was advertised, or if sessions are consistently cancelled by the instructor, a proportionate refund will be issued.
- Recorded Content: If you purchased access to pre-recorded video content, no refund will be issued once access credentials have been shared and activated, except in cases of proven technical inability to access the content.
7. Non-Refundable Items
The following items and amounts are strictly non-refundable under all circumstances:
- Registration / Admission Fee (if charged separately and disclosed at enrollment)
- Uniform (Dobok), belts, gloves, guards, and equipment once issued or used
- Study materials, books, and printed resources once provided
- Tournament / competition registration fees once submitted to the organizing body
- Belt examination / grading fees once the examination has been conducted
- Workshop or seminar fees once the event has taken place
- Late payment penalties already charged
- Processing fees deducted from approved refunds
8. Membership Freeze (Alternative to Cancellation)
Before requesting a cancellation and refund, you may consider freezing your membership — this preserves your progress, belt rank, and batch allocation:
- You may freeze your membership for a minimum of 7 days and a maximum of 30 days per instance.
- Maximum 2 freeze instances are allowed per membership tenure (e.g., per 6-month or 12-month plan).
- Freeze is available for: medical reasons (with doctor's note), outstation travel, examinations, or other genuine circumstances.
- The freeze period will be added to the end of your membership duration.
- Freeze requests must be submitted in writing (email or written application at the academy) at least 3 days in advance.
- During the freeze period, you will not be charged any additional fees, and your membership benefits will be paused.
- Freeze is not available for memberships already in default (unpaid fees) or under disciplinary suspension.
9. Membership Transfer
- Membership is personal and non-transferable by default.
- In exceptional circumstances (e.g., permanent relocation out of Jaipur), you may request a one-time transfer of your remaining membership to an immediate family member (spouse, sibling, or child), subject to:
- Prior written approval from the academy management
- The transferee completing a fresh registration and health declaration
- A nominal transfer processing fee of ₹500
- The transferee agreeing to be bound by all Terms & Conditions
- Transfer requests will be processed within 7 business days.
10. How to Request a Refund or Cancellation
To ensure smooth and timely processing, please follow this procedure:

Step 1: Send a written request via email to omsfitness@gmail.com or submit a physical application at the academy front desk.
Step 2: Include the following details:
- Student's full name and enrollment/membership ID
- Program name and batch timing
- Date of enrollment and total amount paid
- Reason for cancellation/refund request
- Supporting documents (medical certificate, relocation proof, etc., if applicable)
- Preferred refund method (original payment method / bank transfer)
- Bank account details (for NEFT/IMPS transfer, if applicable): Account holder name, Account number, IFSC code
Step 3: Our team will acknowledge your request within 48 business hours.
Step 4: We will review your request and communicate the decision within 7 business days.
Step 5: If approved, the refund will be processed within the timelines mentioned in Section 11.
Important: Verbal requests (phone calls, WhatsApp messages) will be noted but must be followed by a written email or physical application to initiate formal processing. Please retain a copy of your request for your records.
11. Refund Processing Timelines
Once a refund is approved, the processing timeline depends on the original payment method:

These timelines are in addition to our internal processing time of 7 business days for reviewing and approving the refund request. In total, please allow up to 15–21 business days from the date of your request for the refund to reflect in your account.
Note: Refunds will be processed to the original payment method wherever possible. If the original method is no longer available (e.g., closed bank account), please provide alternative bank details. We are not responsible for delays caused by your bank or payment service provider.
12. Cancellation by the Academy
Om's Academy reserves the right to cancel or discontinue any program, batch, or service. In such cases:
- A full refund of all unused fees will be issued within 15 business days — no processing fee will be deducted.
- Alternatively, you may opt for a transfer to an equivalent program or batch at no additional cost.
- If a specific class session is cancelled (e.g., instructor unavailability), a make-up class will be scheduled. If make-up is not feasible, the session value will be credited to your account.
- We will provide at least 7 days' prior notice for planned program discontinuation, except in emergencies.
13. Termination for Cause (No Refund)
No refund will be provided if your membership is terminated due to:
- Violation of the academy's Code of Conduct (as outlined in our Terms & Conditions)
- Aggressive, abusive, discriminatory, or harassing behavior toward staff, coaches, or fellow students
- Theft, vandalism, or damage to academy property
- Providing false or misleading information during registration
- Non-payment of fees beyond 15 days of the due date (after written reminder)
- Unauthorized recording or distribution of class content
In such cases, the decision of the academy management will be final. However, this does not affect your statutory rights under the Consumer Protection Act, 2019, if you believe the termination was unjust.
14. Promotional Offers & Discounted Plans
- Fees paid under promotional or discounted offers (e.g., "Early Bird," "Festival Offer," "Referral Discount") are subject to the same refund rules as regular fees, unless the specific offer states otherwise.
- If a refund is approved for a discounted plan, the refund amount will be calculated based on the actual amount paid (not the original/listed price).
- Promotional offers cannot be combined with other offers unless explicitly stated.
- Any bonus classes, free sessions, or add-ons received as part of a promotion will be adjusted (deducted at standard per-class rate) from the refund amount if the membership is cancelled before completion.
15. Fee Revision & Auto-Renewal
- Fee Revision: We reserve the right to revise fees with at least 30 days' prior written notice. Revised fees will apply from the next billing cycle and will not affect your current paid period. If you do not wish to continue at the revised rate, you may cancel before the new cycle begins and request a refund of any advance paid for the new period.
- No Auto-Renewal Without Consent: In compliance with RBI e-mandate guidelines, we do not auto-debit your account for membership renewal without your explicit fresh consent and a 24-hour pre-debit notification. You will be contacted before your membership expires to confirm renewal.
- Advance Payments: If you have paid fees in advance for multiple months/quarters and wish to cancel mid-period, the pro-rated refund rules in Section 3 will apply.
16. Dispute Resolution
If you are dissatisfied with a refund decision or the processing of your request:
- Step 1 — Internal Review: Write to us at omsfitness@gmail.com with the subject line "Refund Dispute — [Student Name]". We will review your case and respond within 15 business days.
- Step 2 — Mediation: If the dispute remains unresolved, both parties agree to attempt mediation through a mutually agreed mediator in Jaipur, Rajasthan, before initiating legal proceedings.
- Step 3 — Consumer Commission: You have the right to file a complaint with the District Consumer Disputes Redressal Commission, Jaipur under Section 35 of the Consumer Protection Act, 2019. The limitation period for filing is 2 years from the date of the cause of action.
- Step 4 — Courts: Subject to the above, any dispute shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
17. Special Provisions for Minors
- All refund and cancellation requests for students under 18 must be made by the parent or legal guardian who completed the enrollment.
- The parent/guardian must provide their own ID proof along with the refund request.
- Refunds for minors' fees will be processed to the original payment account used at the time of enrollment (i.e., the parent's/guardian's account).
- In case of separation/divorce of parents, the refund will be issued to the parent/guardian who is the registered primary contact, unless a court order specifies otherwise.
18. Tax & Receipts
- A payment receipt will be issued for every fee payment (digital or cash). Please retain this for refund claims.
- If GST is applicable on the fees, the refund amount will be adjusted for the applicable GST component as per prevailing tax laws.
- Refund amounts are subject to any applicable TDS (Tax Deducted at Source) as per the Income Tax Act, 1961, if the refund exceeds the prescribed threshold.
19. Changes to This Policy
- We reserve the right to modify this Refund & Cancellation Policy at any time.
- Changes will be posted on this page with an updated "Last Updated" date.
- Material changes (e.g., changes to refund percentages, cooling-off period, or processing fees) will be communicated to enrolled members via email or notice at the academy at least 15 days before they take effect.
- Changes will not apply retrospectively to fees already paid under the previous policy. Your enrollment will be governed by the policy in effect at the time of your payment.
- Your continued use of our services after the effective date of changes constitutes acceptance of the revised Policy.
